Text Box: Early warning systems to monitor solicitors who are not meeting performance standards may be introduced under the Law Society Regulation Board’s new strategy.

The Board wants to develop new arrangements to give early warning on dishonesty, misconduct, unacceptable professional performance or practices that are in financial difficulties. The Regulation Board, which took up its full powers in January, has now put the new strategy out for consultation to a wide range of groups including consumer organisations.

The key objectives are

Setting standards of entry to the profession, for professional behaviour and continued professional development 
Monitoring of, and support for, the profession to help them comply with standards 
Identification of cases needing remedial, regulatory or investigative action 
Consumer protection, enforcement and discipline 
Promoting access to justice, transparency and education of consumers 

”This strategy aims to ensure that the Law Society can operate as an effective modern regulator. We want the public to know what to expect from their solicitor in terms of good client care, integrity and up-to-date knowledge. Our strategy aims to be risk based and will take into consideration the needs of both individual and commercial clients,” said Peter Williamson, chairman of the Regulation Board.

”There is a new emphasis on professional performance and quality of advice. We are also suggesting prompt action to minimise risk to the public if these standards are not met. We are keen to have feedback on the proposed strategy which sets out our plans for the next three years,” he said.

The draft strategy in full can be found on the Law Society’s website (www.lawsociety.org.uk), and responses should be sent to the Chair of the Regulation Board by 24 June 2006.
